But if you deny the legality of some of the GPL claim you automaticaly lost
the right to use the programe. So...

The nmap writter deny the use of there GPL code to SCO who fight against the
legality of the GPL.

actually even the FSF does not say that about 'free' licenses. they do not recommend the 'license' not the software. they separate the license from the software. perhaps you could learn from their lesson.
