You have to put in NAV packets. I am using the method described in

to create dvd's with dvdauthor from hardware mpeg encoded streams from a Leadtek PVR2000. Works without error messages. The bitrate is not the problem (I tried from 2Mbit to 7.5 Mbit)

I still have to check whether using DVD-stream in the encodings settings makes a difference. (Currently set at Program stream)
