Problems with 2.6.9 kernel and Aver TVPhone98 Card(card 6)

So I've build a 2.6.9 kernel and all my card records is black with a
little bit of static at the top, i've tried every tuner setting there
and all have the same results. I used to run a 2.6.8-something(ubuntu
install) and it worked there but lirc wouldn't build, with 2.6.9 lirc
builds but the card shows no video.

Any help is appreciated.
