I know a bit more about copyrights than how to select the best black ink for
whatever Epson, so...
As soon as you took the pictures they supposedly hold your copyright, but if
they are not registered you will have much more trouble in enforcing your
exclusive right to use them. Can you put them in an organized book or
portfolio as the equivalent of a publication? Then you could copyright all
of them as part of that publication with a $30 fee. If they are later
published the resulting publication would again be copyrighted as a specific
collection.

taken of a 7 yr. old boy and his 5 yr. old sister just below Abrams Falls in
the Smoky Mtns they were both dressed as the poor farm Mtn. children did at
the turn of the century and that takes me to my final question even though
you can't reconize them do I need a signed agreement to use this photo? or
release? Any info will be greatly appreciated. Thanks

Yes indeed you need releases. Publishers will be reluctant to publish them
without releases, and in fact you will probably have to swear that you have
releases (hold harmless clause) as part of a contract with the publisher. Oh
the other hand, will the subjects ever see the published prints?
