I am an Epson enthusiast, and, though I seldom admit it these days, an
attorney. My only comment is that I hope to God Microsoft doesn't get hold
of this thread. Then anything I write with MS Word will have their
copyright. Ultimately, there's Adobe....
I haven't read all the messages, but as I understand it the controversy is
whether a profile generated by a publisher's software is restricted in
distribution. This could well be the case, as two people can contract with
any terms they want, within limits imposed by the courts and laws. In that
case, the marketplace would welcome the next software publisher who did not
impose such a term. Having said that, I cannot at the moment think of
another patent or copyright protected item where the work product is
similarly restricted. There probably is one, and maybe I would be surprised
if I got a magnifying glass and read the terms. I am not a professional
photographer, but my friends who are carry property releases as well as
model releases. I can't imagine a restriction on photographing public
(taxpayer-funded)places (exclude France, of course), though the authorities
are free to set restrictions (e.g., no tripods).
