In most of the weddings I've attended, either as a photographer or as a
singer (another hat), the priest or pastor has asked that guests not use
flash inside the church. In fact, years back we were asked not to take
pictures - with or without fash - inside the church at all as a mark of
respect for the location. Given the secular nature of society there's
always some jackass who ignores the request. Generally the priest
ignores it, but I was at a wedding once where the priest got so
irritated that he refused to continue until the offending individual
took his cameras outside.
In one sense the Eiffel Tower lighting could be considered a work of
performance art subject to the rights of the artist or the assigned
owner, in this case the lighting company. For non-commercial use there
would be (could be) no enforcement, but there certainly would be for
commercial photographs. Whether a similar setup would be enforceable in
law in the U.S. would depend on the contract between the lighting
company and the monument owner if the owner were a public body, but
surely it would be enforceable if the lighting were part of a
performance at a private venue?
In the case of an individual profile passed along on a non-commercial
basis the software vendor would have a difficult time enforcing the
restrictions on use on a practical level, but I would expect the vendor
to take action if an individual distributed more than a few copies even
if no money changed hands. The threshold number would depend on how many
sales the vendor thought the copies in circulation were costing him. And
yes, it would be a civil suit, not a criminal prosecution.
